How to transfer (sign over) a Montana Title or LLC

Signing over a title, or any legal document can feel intimidating, but it shouldn’t have to be. Whether you need assistance with transferring ownership of a vehicle with a Montana title, or with transferring the LLC that owns the vehicle, we’re here to help make that process as simple as possible.

Signing over a title

Signing over a Montana title can be broken down into 3 steps:

  1. The seller (Usually one of the owners of the Montana LLC) will sign the title, releasing interest in the vehicle. This MUST be done in front of a Notary.

  2. The Notary will sign and stamp the title, validating that they witnessed the seller release interest in the vehicle.

  3. The buyer will sign the title, obtaining an interest in the vehicle. If the buyer will be registering under a Montana LLC or any LLC for that matter, the buyer will PRINT the name of the LLC and sign their signature. They will not print their personal name unless they will be registering the vehicle in their name and not a business name.

The most important part of signing over a Montana title is making sure that a Notary verifies the seller’s identity, and then witnesses them sign the title. In fact, the owner of the vehicle can even get their title notarized WITHOUT the buyer being present.

  • This can be especially convenient when it comes time to sell the vehicle, as the sale won’t need to be interrupted by a trip to your local notary.

  • This is helpful if something happens to you and somebody else needs to sell the vehicle for you, like a family member, as you have already notarized the title.

  • This also enables a seller to transfer ownership of the vehicle without meeting the buyer face to face, in the circumstance that you wish to mail the title to your prospective buyer.

If an LLC is listed as the owner on the title, the Notary may request that the seller provide the articles of organization for the LLC showing the seller has the right to sign on behalf of the LLC. We provide this document at the time of an LLC getting approved.

What if a mistake was made when signing over the title?

  • If the seller made a mistake, we can assist them with obtaining a duplicate title HERE. They must be the owner listed on the title.

  • If the buyer (our customer) makes a mistake, we can handle all corrections and additional paperwork needed on their behalf using our Power of Attorney. We can usually fix most issues with little to no delay to your order.

What must be completed before sending my title to Dirt Legal?

  • Below you will find an example of the minimum requirements (in red) that must be completed by the seller and notary before sending your title to Dirt Legal. We can assist with everything else needed by using our power of attorney.

With Dirt Legal as your Power of Attorney, we can complete signing your title over on your behalf, as long as the minimum requirements above (in red) have been completed already.

Selling an LLC that owns a Montana vehicle without actually transferring vehicle ownership

If you are no longer interested in keeping your LLC, an alternative solution is to transfer ownership of your LLC to the buyer. By doing this, the assets of the LLC are transferred to the new owner. This means that any vehicles that the LLC owns maintain their current registration, and are simply transferred with the LLC to the new owner.

  • Because the vehicle is already registered, you won’t have to hire us to register the vehicle, nor will you have to contact any DMV.

  • Once your LLC is transferred, you can provide the new LLC owner with the existing plate and registration for the vehicle owned by the LLC.
